Superior Court Offenses

In New Jersey, the Municipal Courts generally handle matters involving traffic offenses and disorderly and petty disorderly offenses. These are cases, which, although serious, do not involve jury trials.  Once these cases are resolved, fines are generally assessed and the matter is closed.

More serious crimes are handled in the Superior Courts of New Jersey. These cases are referred to as indictable crimes.  An indictable crime, also known as a felony in other jurisdictions, involves offenses which, if proven, may subject an individual to serious consequences, such as a lengthy prison term.  In New Jersey, indictable offenses range from Fourth Degree, which are the less serious indictable offenses such as drug possession, to First Degree, which involve charges such as murder, manslaughter, and sexual offenses.

If you are arrested for an indictable crime, it is important to obtain experienced legal counsel as soon as possible.  The firm is prepared to handle your case from its beginning to its resolution.  Our attorneys have extensive experience in jury trials and plea negotiations, so you will receive the most informed legal opinion regarding a potential outcome of your case.  There are many aspects to a criminal prosecution in Superior Court.  Some cases may be selected for early disposition, which is a way to avoid a Grand Jury Indictment.  This may allow an arrested person the benefit of an early disposition of their case. Other cases will proceed through the Grand Jury system in the county where you are charged.  A Grand Jury is comprised of a panel of 23 citizens who hear and decide if sufficient evidence exists to sustain the charges brought against you.  This step is then followed by the pre-arraignment notification letter, which advises a person they have been indicted, and the case will proceed in Superior Court. At  the arraignment,  we will represent you in all negotiations with the court and prosecutor, and determine if motions are needed to be filed, discovery obtained, and review all plea offers with you to determine what is in your best interests.
